Indonesia&#8217;s official regulation database records the regulation as in force and states that it revoked Government Regulation No. 5 of 2021.<\/p>\n<p>This is relevant when reviewing older feasibility studies, transaction documents, or legal memos. Material prepared under the previous licensing framework may need to be checked again before investors rely on it for a 2026 project.<\/p>\n<h3>Check Foreign Ownership at the Business-Activity Level<\/h3>\n<p>Presidential Regulation No. 10 of 2021, as amended by Presidential Regulation No. 49 of 2021, remains central to Indonesia&#8217;s investment business-field framework. Presidential Regulation No. 49 of 2021 is listed by the government&#8217;s regulation database as in force.<\/p>\n<p>Foreign ownership therefore needs to be checked against the exact activity rather than the broad description &#8220;digital infrastructure.&#8221; Indonesia&#8217;s <a href=\"https:\/\/investinasia.id\/blog\/indonesia-positive-investment-list\/\">Positive Investment List<\/a> is the starting framework, but sector-specific conditions may still affect how a project is structured.<\/p>\n<h3>Check Whether Sector Standards Apply<\/h3>\n<p>Minister of Communication and Digital Regulation No. 15 of 2025 sets business and product or service standards for risk-based licensing in postal, telecommunications, broadcasting, and electronic-system activities. Komdigi&#8217;s legal database lists the regulation as in force.<\/p>\n<p>An investor should therefore separate the physical asset from the services provided through that asset. Owning a building, tower, cable, or technical facility does not automatically produce the same licensing obligations as operating a regulated network or electronic service.<\/p>\n<h3>Treat PSE and Personal-Data Rules as Separate Questions<\/h3>\n<p>Electronic-system requirements should not be reduced to a blanket assumption that every private company must keep all data inside Indonesia.
