{"id":407,"date":"2025-09-30T09:55:37","date_gmt":"2025-09-30T09:55:37","guid":{"rendered":"https:\/\/whimsical-pyramid.localsite.io\/?p=407"},"modified":"2025-09-30T09:55:37","modified_gmt":"2025-09-30T09:55:37","slug":"malaysia","status":"publish","type":"post","link":"https:\/\/investinasia.id\/education\/tax-treaty\/malaysia\/","title":{"rendered":"Malaysia"},"content":{"rendered":"<div class=\"document-body\">\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>AGREEMENT BETWEEN<br \/>\n                THE GOVERNMENT OF THE REPUBLIC OF INDONESIA<br \/>\n                AND<br \/>\n                THE GOVERNMENT OF MALAYSIA<\/b><\/p>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <span style=\"font-weight: bold; font-size: 14px;\" data-asw-orgfontsize=\"14\">FOR<\/span><br \/>\n              <b>THE AVOIDANCE OF DOUBLE TAXATION AND THE PREVENTION OF FISCAL EVASION WITH RESPECT TO TAXES ON<br \/>\n                INCOME<\/b><\/p>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 1<br \/>\n                PERSONAL SCOPE<\/b><\/p>\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              This Agreement shall apply to persons who are residents of one or both of the Contacting States.<\/p>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 2<br \/>\n                TAXES COVERED<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  This Agreement shall apply to taxes on income imposed by a Contracting State, irrespective of the<br \/>\n                  manner in which they are levied.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The taxes, which are the subject of this Agreement are:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n                        in lndonesia, the income tax (paiak penghasilan);<br \/>\n                        (hereinafter referred to as &#8220;Indonesian tax&#8221;).<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" rowspan=\"5\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n                        In Malaysia:<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (i)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the income tax and excess profit tax;<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (ii)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the supplementary income tax, that is, development and<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (iii)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the petroleum income tax;<\/td>\n<\/tr>\n<tr>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n                        (hereinafter referred to as &#8220;Malaysian tax&#8221;).<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  This Agreement shall also apply to any identical or substantially similar taxes on income which are<br \/>\n                  imposed after the date of signature of this Agreement in addition to, or in place of, the existing<br \/>\n                  taxes. The competent authorities of the Contracting States shall notify each other of important<br \/>\n                  changes which have been made in their respective taxation laws.<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 3<br \/>\n                GENERAL DEFINITIONS<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of this Agreement, unless the context otherwise requires:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;Indonesia&#8221; comprises the territory of the Republic of Indonesia as defined in its<br \/>\n                          laws, and parts of the Continental Shelf and adjacent seas, over which the Republic of<br \/>\n                          Indonesia has sovereignty, sovereign rights or other rights in accordance with international<br \/>\n                          law;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;Malaysia&#8221; means the Federation of Malaysia and includes any area adjacent to the<br \/>\n                          territorial waters of Malaysia which, in accordance with international law, has been or may<br \/>\n                          hereafter be designated under the laws of Malaysia concerning the Continental Shelf as an area<br \/>\n                          within which the rights of Malaysia with respect to the exploration and exploitation of<br \/>\n                          natural resources, whether living or non- living, of the seabed and subsoil and the<br \/>\n                          superjacent waters, may be exercised;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (c)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the terms &#8220;a Contracting State&#8221; and &#8220;the other Contracting State&#8221; mean Malaysia or Indonesia<br \/>\n                          as the context requires;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (d)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;tax&#8221; means Malaysian tax or Indonesian tax, as the context requires;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (e)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;person&#8221; includes an individual, a company and any other body of persons which is<br \/>\n                          treated as an entity for tax purposes;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (f)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;company&#8221; means any body corporate or any entity which is treated as a body corporate<br \/>\n                          for tax purposes;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (g)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the terms &#8220;enterprise of a Contracting State&#8221; and &#8220;enterprise of the other Contracting State&#8221;<br \/>\n                          mean respectively an enterprise carried on by a resident of a Contracting State and an<br \/>\n                          enterprise carried on by a resident of the other Contracting State;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" rowspan=\"3\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (h)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;national&#8221; means:<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"27\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (i)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          any individual possessing the citizenship or nationality of a Contracting State;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"27\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (ii)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          any legal person, partnership, association and any other entity deriving its status as such<br \/>\n                          from the laws in force in a Contracting State;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (i)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;international traffic&#8221; means any transport by a ship or aircraft operated by an<br \/>\n                          enterprise of a Contracting State, except when the ship or aircraft is operated solely between<br \/>\n                          places in the other Contracting State;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" rowspan=\"3\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (j)<\/td>\n<td valign=\"top\" colspan=\"2\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the term &#8220;competent authority&#8221; means:<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (i)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          in the case of Malaysia, the Minister of Finance or his authorized representative;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (ii)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          in the case of Indonesia, the Minister of Finance or his authorized representative.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  In the application of the Agreement by a Contracting State, any term not defined therein shall, unless<br \/>\n                  the context otherwise requires, have the meaning which it has under the laws of that Contracting State<br \/>\n                  concerning the taxes to which the Agreement applies.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 4<br \/>\n                RESIDENT<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of this Agreement, the term &#8220;resident of a Contracting State&#8221; means:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          in the case of Malaysia, a person who is resident in Malaysia for the purposes of Malaysian<br \/>\n                          tax; and<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          in the case of Indonesia, a person who is resident in Indonesia for the purposes of Indonesian<br \/>\n                          tax.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where by reason of the provisions of paragraph 1 an individual is a resident of both Contracting<br \/>\n                  States, then his status shall be determined as follows;<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td style=\"vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          he shall be deemed to be a resident of the State in which he has a permanent home available to<br \/>\n                          him. If he has a permanent home available to him in both States, he shall be deemed to be a<br \/>\n                          resident of the State with which his personal and economic relations are closer (centre of<br \/>\n                          vital interests);&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          if the State in which he has his centre of vital interests cannot be determined, or if he has<br \/>\n                          not a permanent home available to him in either State, he shall be deemed to be a resident of<br \/>\n                          the State in which he has an habitual abode;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (c)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          if he has an habitual abode in both States or in neither of them, the competent authorities of<br \/>\n                          the Contracting States shall settle the question by mutual agreement.&nbsp;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where, by reason of paragraph 1, a person other than an individual is a resident of both Contracting<br \/>\n                  States, the competent authorities of the Contracting States shall by mutual agreement endeavour to<br \/>\n                  settle the question having regard to its day-to-day management, the place where it is incorporated or<br \/>\n                  otherwise constituted and any other relevant factors.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 5<br \/>\n                PERMANENT ESTABLISHMENT<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of this Agreement, the term &#8220;permanent establishment&#8221; means a fixed place of business<br \/>\n                  through which the business of the enterprise is wholly or partly carried on.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;permanent establishment&#8221; or<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td style=\"vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          substantial equipment is in that other State being used or installed by, for or under contract<br \/>\n                          with, the enterprise.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  A person (other than a broker, general commission agent or any other agent of an independent status to<br \/>\n                  whom paragraph 6 applies) acting in a Contracting State on behalf of an enterprise of the other<br \/>\n                  Contracting State shall be deemed to be a permanent establishment in the first-mentioned State, if:\n                <\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          he has, and habitually exercises in the first-mentioned State, an authority to conclude<br \/>\n                          contracts in the name of the enterprise, unless his activities are limited to the purchase of<br \/>\n                          goods or merchandise for the enterprise;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td style=\"vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          he maintains in the first-mentioned State a stock of goods or merchandise belonging to the<br \/>\n                          enterprise from which he regularly fills orders on behalf of the enterprise; or&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (c)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          he manufactures or processes in the first-mentioned State for the enterprise goods or<br \/>\n                          merchandise belonging to the enterprise.&nbsp;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  An enterprise of a Contracting State shall not be deemed to have a permanent establishment in the<br \/>\n                  other Contracting State merely because it carries on business in that other State through a broker,<br \/>\n                  general commission agent or any other agent of an independent status, where such persons are acting in<br \/>\n                  the ordinary course of their business.&nbsp;However, when the activities of such an agent are devoted<br \/>\n                  wholly or almost wholly on behalf of that enterprise, he shall not be considered an agent of an<br \/>\n                  independent status within the meaning of this paragraph.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The fact that a company which is a resident of a Contracting State controls or is controlled by a<br \/>\n                  company which is a resident of the other Contracting State, or which carries on business in that other<br \/>\n                  State (whether through a permanent establishment or otherwise), shall not of itself constitute either<br \/>\n                  company a permanent establishment of the other.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 6<br \/>\n                INCOME FROM IMMOVABLE PROPERTY<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Income derived by a resident of a Contracting State from immovable property situated in the other<br \/>\n                  Contracting State may be taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of this Agreement, the term &#8220;immovable property&#8221; shall be defined in accordance with<br \/>\n                  the laws of the Contracting State in which the property in question is situated. The term shall in any<br \/>\n                  case include property accessory to immovable property, livestock and equipment used in agriculture and<br \/>\n                  forestry, rights to which the provisions of general law respecting landed property apply, usufruct of<br \/>\n                  immovable property and rights to variable or fixed payments as consideration for the working of, or<br \/>\n                  the right to work, mineral deposits, oil or gas wells, quarries and other places of extracting of<br \/>\n                  natural resources including timber or other forest produce. Ships, boats and aircraft shall not be<br \/>\n                  regarded as immovable property.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraph 1 shall also apply to income derived from the direct use, letting, or use<br \/>\n                  in any other form of immovable property.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraphs 1 and 3 shall also apply to the income from immovable property of an<br \/>\n                  enterprise and to income from immovable property used for the performance of professional<br \/>\n                  services.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 7<br \/>\n                BUSINESS PROFITS<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The profits of an enterprise of a Contracting State shall be taxable only in that State unless the<br \/>\n                  enterprise carries on business in the other Contracting State through a permanent establishment<br \/>\n                  situated therein. If the enterprise carries on business as aforesaid, the profits of the enterprise<br \/>\n                  may be taxed in the other State but only on so much thereof as is attributable to that permanent<br \/>\n                  establishment.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to the provisions of paragraph 3, where an enterprise of a Contracting State carries on<br \/>\n                  business in the other Contracting State through a permanent establishment situated therein, there<br \/>\n                  shall in each Contracting State be attributed to that permanent establishment the profits which it<br \/>\n                  might be expected to make if it were a distinct and separate enterprise engaged in the same or similar<br \/>\n                  activities under the same or similar conditions and dealing wholly independently with the enterprise<br \/>\n                  of which it is a permanent establishment.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  In determining the profits of a permanent establishment, there shall be allowed as deductions expenses<br \/>\n                  including executive and general administrative expenses, which would be deductible if the permanent<br \/>\n                  establishment were an independent enterprise, insofar as they are reasonably allocable to the<br \/>\n                  permanent establishment, whether incurred in the State in which the permanent establishment is<br \/>\n                  situated or elsewhere.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  If the information available to the competent authority is inadequate to determine the profits to be<br \/>\n                  attributed to the permanent establishment of an enterprise, nothing in this Article shall affect the<br \/>\n                  application of any law of that State relating to the determination of the tax liability of a person by<br \/>\n                  the exercise of a discretion or the making of an estimate by the competent authority, provided that<br \/>\n                  the law shall be applied, so far as the information available to the competent authority permits, in<br \/>\n                  accordance with the principle of this Article.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  No profits shall be attributed to a permanent establishment by reason of the mere purchase by that<br \/>\n                  permanent establishment of goods or merchandise for the enterprise.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purpose of the preceding paragraphs, the profits to be attributed to the permanent<br \/>\n                  establishment shall be determined by the same method year by year unless there is good and sufficient<br \/>\n                  reason to the contrary.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where profits include items of income which are dealt with separately in other Articles of this<br \/>\n                  Agreement, then the provisions of those Articles shall not be affected by the provisions of this<br \/>\n                  Article.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 8<br \/>\n                SHIPPING AND AIR TRANSPORT<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Profits derived from the operation of ships or aircraft in international traffic shall be taxable only<br \/>\n                  in the Contracting State in which the place of effective management of the enterprise is situated.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of paragraph 1, profits derived by an enterprise of a Contracting State<br \/>\n                  from the operation of ships in international traffic may be taxed in the other Contracting State, but<br \/>\n                  the tax imposed in that other State shall be reduced by an amount equal to 50% thereof.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of paragraphs 1 and 2 and Article 7, profits derived by an enterprise<br \/>\n                  of a Contracting State from a voyage of ships or aircraft where the principal purpose of the voyage is<br \/>\n                  to transport passengers or goods between places in the other Contracting State shall be taxed in that<br \/>\n                  other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Paragraphs 1 and 2 shall also apply to the share of the profits from the operation of ships or<br \/>\n                  aircraft derived by a resident of a Contracting State through participation in a pool, a joint<br \/>\n                  business or an international operating agency.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 9<br \/>\n                ASSOCIATED ENTERPRISES<\/b><\/p>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              Where:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"35\" the same persons participate directly or indirectly in the management, control or capital of an<br \/>\n                      enterprise of a Contracting State and an enterprise of the other Contracting State,&nbsp;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<div class=\"art-pleft\">\n              <\/p>\n<div style=\"text-align: justify;\">\n                and in either case conditions are made or imposed between the two enterprises in their commercial or<br \/>\n                financial relations which differ from those which would be made between independent enterprises, then<br \/>\n                any profits which would, but for those conditions, have accrued to one of the enterprises, but, by<br \/>\n                reason of those conditions, have not so accrued, may be included in the profits of that enterprise and<br \/>\n                taxed accordingly.<\/div>\n<\/p><\/div>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                 Contracting State may be taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Dividends paid by a company which is a resident of Indonesia to a resident of Malaysia may be taxed in<br \/>\n                  Indonesia in accordance with the laws of Indonesia but if the recipient is the beneficial owner of the<br \/>\n                  dividends the tax so charged shall not exceed 15% of the gross amount of the dividends.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Dividends paid by a company which is a resident of Malaysia to a resident of Indonesia who is the<br \/>\n                  beneficial owner thereof shall be exempt from any tax in Malaysia which is chargeable on dividends in<br \/>\n                  addition to the tax chargeable in respect of the income of the company. Nothing in this paragraph<br \/>\n                  shall affect the provisions of the Malaysian law under which the tax in respect of a dividend paid by<br \/>\n                  a company which is a resident of Malaysia from which Malaysian tax has been, or has been deemed to be,<br \/>\n                  deducted may be adjusted by reference to the rate of tax appropriate to the Malaysian year of<br \/>\n                  assessment immediately following that in which the dividend was paid.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;dividends&#8221; as used in this Article means income from shares or other rights, not being<br \/>\n                  debt-claims, participating in profits, as well as income from other corporate rights which is<br \/>\n                  subjected to the same taxation treatment as income from shares by the laws of the State of which the<br \/>\n                  company making the distribution is a resident.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraphs 1, 2 and 3 shall not apply if the beneficial owner of the dividends,<br \/>\n                  being a resident of a Contracting State, carries on business in the other Contracting State, of which<br \/>\n                  the company paying the dividends is a resident, through a permanent establishment situated therein,<br \/>\n                  and the holding in respect of which the dividends are paid is effectively connected with such<br \/>\n                  permanent establishment. In such a case, the provisions of Article 7 shall apply.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where a company which is a resident of a Contracting State derives income or profits from the other<br \/>\n                  Contracting State, that other State may not impose any tax on the dividends paid by the company to<br \/>\n                  persons who are not residents of that other State, or subject the company&#8217;s undistributed profits to a<br \/>\n                  tax on undistributed profits, even if the dividends paid or the undistributed profits consist wholly<br \/>\n                  or partly of income or profits arising in that other State.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 11<br \/>\n                INTEREST<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Interest arising in a Contracting State and paid to a resident of the other Contracting State may be<br \/>\n                  taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  However, such interest may be taxed in the Contracting State in which it arises, and according to the<br \/>\n                  laws of that State, but if the recipient is the beneficial owner of the interest, the tax so charged<br \/>\n                  shall not exceed 15% of the gross amount of the interest.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of paragraph 2, interest to which a resident of Indonesia is<br \/>\n                  beneficially entitled shall be exempt from Malaysian tax if the loan or other indebtedness in respect<br \/>\n                  of which the interest is paid is an approved loan as defined in section 2(1) of the Income Tax Act<br \/>\n                  1967 of Malaysia.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of paragraphs 2 and 3, the Government of a Contracting State shall be<br \/>\n                  exempt from tax in the other Contracting State in respect of interest derived by the Government from<br \/>\n                  that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For purposes of paragraph 4, the term &#8220;Government&#8221;:&nbsp;<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" rowspan=\"5\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n                        in the case of Indonesia means the Government of the Republic of Indonesia and shall include:\n                      <\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (i)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the local authorities;<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (ii)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the statutory bodies;<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (iii)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        Bank Indonesia (the Central Bank of Indonesia); and<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (iv)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          such institutions, the capital of which is wholly owned by the Government of the Republic of<br \/>\n                          Indonesia or the local authorities or the statutory bodies thereof, as may be agreed upon from<br \/>\n                          time to time between the competent authorities of the Contracting States.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" rowspan=\"6\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          in the case of Malaysia means the Government of Malaysia and shall include:&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (i)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the Governments of the States;<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (ii)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the local authorities;<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (iii)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the statutory bodies;<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (iv)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        Bank Negara Malaysia; and<\/td>\n<\/tr>\n<tr>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (v)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          such institutions, the capital of which is wholly owned by the Government of Malaysia or the<br \/>\n                          Governments of the States or the local authorities or the statutory bodies thereof, as may be<br \/>\n                          agreed upon from time to time between the competent authorities of the Contracting States;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;interest&#8221; as used in this Article means income from debt-claims of every kind, whether or<br \/>\n                  not secured by mortgage, and whether or not carrying a right to participate in the debtor&#8217;s profits,<br \/>\n                  and in particular, income from government securities and income from bonds and debentures.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraphs 1, 2 and 3 shall not apply if the beneficial owner of the interest, being<br \/>\n                  a resident of a Contracting State, carries on business in the other Contracting State in which the<br \/>\n                  interest arises, through a permanent establishment situated therein and the debt-claim in respect of<br \/>\n                  which the interest is paid is effectively connected with such permanent establishment. In such a case,<br \/>\n                  the provisions of Article 7 shall apply.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Interest shall be deemed to arise in a Contracting State when the payer is that State itself, a<br \/>\n                  political subdivision, a local authority or statutory body thereof, or a resident of that State.<br \/>\n                  Where, however, the person paying the interest, whether he is a resident of a Contracting State or<br \/>\n                  not, has in a Contracting State a permanent establishment in connection with which the indebtedness on<br \/>\n                  which the interest is paid was incurred, and such interest is borne by such permanent establishment,<br \/>\n                  then such interest shall be deemed to arise in the State in which the permanent establishment is<br \/>\n                  situated.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where, by reason of a special relationship between the payer and the beneficial owner or between both<br \/>\n                  of them and some other person, the amount of the interest paid, having regard to the debt- claim for<br \/>\n                  which it is paid, exceeds the amount which would have been agreed upon by the payer and the beneficial<br \/>\n                  owner in the absence of such relationship, the provisions of this Article shall apply only to the<br \/>\n                  last-mentioned amount. In such a case, the excess part of the payments shall remain taxable according<br \/>\n                  to the laws of each Contracting State, due regard being had to the other provisions of this<br \/>\n                  Agreement.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 12<br \/>\n                ROYALTIES<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Royalties arising in a Contracting State and paid to a resident of the other Contracting State may be<br \/>\n                  taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  However, such royalties may also be taxed in the Contracting State in which they arise, and according<br \/>\n                  to the laws of that State, but if the recipient is the beneficial owner of the royalties, the tax so<br \/>\n                  charged shall not exceed 15% of the gross amount of the royalties.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;royalties&#8221; as used in this Article means payments of any kind received as consideration<br \/>\n                  for:&nbsp;<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (i)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the use of, or the right to use, any patent, trade mark, design or model, plan, secret formula<br \/>\n                          or process, or any copyright of scientific work, or for the use of, or the right to use,<br \/>\n                          industrial, commercial or scientific equipment, or for information concerning industrial,<br \/>\n                          commercial or scientific experience;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (ii)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the use of, or the right to use, cinematograph films, or tapes for radio or television<br \/>\n                          broadcasting, any copyright of literary or artistic work.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the royalties, being a<br \/>\n                  resident of a Contracting State, carries on business in the other Contracting State in which the<br \/>\n                  royalties arise through a permanent establishment situated therein and the right or property in<br \/>\n                  respect of which the royalties are paid is effectively connected with such permanent establishment. In<br \/>\n                  such a case, the provisions of Article 7 shall apply.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Royalties shall be deemed to arise in a Contracting State when the payer is that Contracting State<br \/>\n                  itself, a political subdivision, a local authority or a statutory body thereof, or a resident of that<br \/>\n                  State. Where, however, the person paying such royalties, whether he is a resident of a Contracting<br \/>\n                  State or not, has in a Contracting State a permanent establishment in connection with which the<br \/>\n                  obligation to pay the royalties was incurred, and such royalties are borne by such permanent<br \/>\n                  establishment or fixed base, then such royalties shall be deemed to arise in the State in which the<br \/>\n                  permanent establishment is situated.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where, by reason of a special relationship between the payer and the beneficial owner or between both<br \/>\n                  of them and some other person, the amount of the royalties paid, having regard to the use, right or<br \/>\n                  information for which they are paid, exceeds the amount which would have been agreed upon by the payer<br \/>\n                  and the beneficial owner in the absence of such relationship, the provisions of this Article shall<br \/>\n                  apply only to the last-mentioned amount. In such a case, the excess part of the payments shall remain<br \/>\n                  taxable according to the laws of each Contracting State, due regard being had to the other provisions<br \/>\n                  of this Agreement.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to paragraph 5 of Article 22, royalties derived by a resident of Indonesia which are subjected<br \/>\n                  to film hire duty under the Cinematograph Film-Hire Duty Act in Malaysia shall not be liable to<br \/>\n                  Malaysian tax to which this Agreement applies.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 13<br \/>\n                GAINS FROM THE ALIENATION OF PROPERTY<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Gains from the alienation of immovable property, as defined in paragraph 2 of Article 6, may be taxed<br \/>\n                  in the Contracting State in which such property is situated.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Gains from the alienation of movable property forming part of the business property of a permanent<br \/>\n                  establishment, which an enterprise of a Contracting State has in the other Contracting State or of<br \/>\n                  movable property available to a resident of a Contracting State in the other Contracting State for the<br \/>\n                  purpose of performing professional services, including such gains from the alienation of such a<br \/>\n                  permanent establishment (alone or together with the whole enterprise) may be taxed in the other State.<br \/>\n                  However, gains from the alienation of ships or aircraft operated by an enterprise of a Contracting<br \/>\n                  State in international traffic and movable property pertaining to the operation of such ships or<br \/>\n                  aircraft shall be taxable only in the State of which the enterprise is a resident.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Gains from the alienation of shares of a company, the property of which consists principally of<br \/>\n                  immovable property situated in a Contracting State, may be taxed in that State. Gains from the<br \/>\n                  alienation of an interest in a partnership or a trust, the property of which consists principally of<br \/>\n                  immovable property situated in a Contracting State, may be taxed in that State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Gains from the alienation of any property or assets, other than those mentioned in paragraphs 1, 2 and<br \/>\n                  3 of this Article, shall be taxable only in the Contracting State of which the alienator is a<br \/>\n                  resident.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 14<br \/>\n                PERSONAL SERVICES<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to the provisions of Articles 15, 16, 17, 18, 19 and 20, salaries, wages and similar<br \/>\n                  remuneration or income derived by a resident of a Contracting State in respect of professional<br \/>\n                  services or other activities of a similar character, shall be taxable only in that State unless the<br \/>\n                  services or activities are exercised or performed in the other Contracting State. If the employment,<br \/>\n                  services or activities are so exercised or performed, such remuneration or income as is derived<br \/>\n                  therefrom may be taxed in the other State.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of paragraph 1, remuneration or income derived by a resident of a<br \/>\n                  Contracting State in respect of an employment, services or activities exercised or performed in any<br \/>\n                  calendar year in the other Contracting State shall be taxable only in the first-mentioned State, if:\n                <\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the recipient is present in that other State for a period or periods not exceeding in the<br \/>\n                          aggregate 183 days in the calendar year concerned;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td style=\"vertical-align: top; and&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (c)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          the remuneration or income is not borne by a permanent establishment which the person paying<br \/>\n                          the remuneration has in the other State.&nbsp;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;professional services&#8221; includes independent scientific, literary, artistic, educational or<br \/>\n                  teaching activities as well as the independent activities of physicians, lawyers, engineers,<br \/>\n                  architects, dentists and accountants.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the preceding provisions of this Article, remuneration in respect of an employment<br \/>\n                  exercised on board a ship or aircraft operated in international traffic by an enterprise of a<br \/>\n                  Contracting State, shall be taxable only in that State.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 15<br \/>\n                DIRECTORS&#8217; FEES<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Directors&#8217; fees and similar payments derived by a resident of a Contracting State in his capacity as a<br \/>\n                  member of the board of directors of a company which is a resident of the other Contracting State, may<br \/>\n                  be taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The remuneration which a person to whom paragraph 1 applies derives from the company in respect of the<br \/>\n                  discharge of day-to-day functions of a managerial or technical nature may be taxed in accordance with<br \/>\n                  the provisions of Article 14 (Personal services).&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 16<br \/>\n                ARTISTES AND ATHLETES<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Notwithstanding the provisions of Article 14, income derived by a resident of a Contracting State as<br \/>\n                  an entertainer, such as a theatre, motion picture, radio or television artiste, or a musician, or as<br \/>\n                  an athlete, from his personal activities as such exercised in the other Contracting State, may be<br \/>\n                  taxed in that other State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where income in respect of personal activities exercised by an entertainer or an athlete in his<br \/>\n                  capacity as such accrues not to the entertainer or athlete himself but to another person, that income<br \/>\n                  may, notwithstanding the provisions of Articles 7 and 14, be taxed in the Contracting State in which<br \/>\n                  the activities of the entertainer or athlete are exercised.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The provisions of paragraphs 1 and 2 shall not apply to remuneration or profits derived from<br \/>\n                  activities exercised in a Contracting State if the visit to that State is directly or indirectly<br \/>\n                  supported wholly or substantially from the public funds of the other Contracting State, a political<br \/>\n                  subdivision, a local authority or statutory body thereof.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 17<br \/>\n                PENSIONS AND ANNUITIES<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to the provisions of paragraph 2 of Article 18, any pensions or other similar remuneration for<br \/>\n                  past employment or any annuity arising in a Contracting State and paid to a resident of the other<br \/>\n                  Contracting State shall be taxable only in that other State.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The term &#8220;annuity&#8221; includes a stated sum payable periodically at stated times, during life or during a<br \/>\n                  specified or ascertainable period of time, under an obligation to make the payments in return for<br \/>\n                  adequate and full consideration in money or money&#8217;s worth.<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 18<br \/>\n                GOVERNMENT SERVICE<\/b><\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"39\" valign=\"top\" style=\"text-align: center; font-size: 14px;\" rowspan=\"4\" data-asw-orgfontsize=\"14\">\n                    1.<\/td>\n<td width=\"35\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    (a)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                      Remuneration, other than a pension, paid by a Contracting State or a political subdivision, a<br \/>\n                      local authority or a statutory body thereof to any individual in respect of services rendered to<br \/>\n                      that State or political subdivision, local authority or statutory body thereof shall be taxable<br \/>\n                      only in that State.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"35\" valign=\"top\" rowspan=\"3\" colspan=\"1\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    (b)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"2\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                      However, such remuneration shall be taxable only in the other Contracting State if the services<br \/>\n                      are rendered in that State and the recipient is a resident of that State who:&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"31\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    (i)<\/td>\n<td style=\"vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    3.<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" colspan=\"3\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                      The provisions of Articles 14, 15 and 17 shall apply to remuneration or pensions in respect of<br \/>\n                      services rendered in connection with any trade or business carried on by a Contracting State or a<br \/>\n                      political subdivision, a local authority or a statutory body thereof.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <br \/>\n              <b>Article 19<br \/>\n                STUDENTS AND TRAINEES<\/b><\/p>\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              An individual who is a resident of a Contracting State immediately before making a visit to the other<br \/>\n              Contacting State and is temporarily present in the other State solely:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"38\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    (a)<\/td>\n<td style=\"vertical-align: top; vertical-align: top; font-size: 14px;\" rowspan=\"1\" colspan=\"3\" data-asw-orgfontsize=\"14\">\n<div class=\"art-pleft\">\n                      shall be exempt from tax in that other State on:<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"38\" valign=\"top\" rowspan=\"3\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    &nbsp;<\/td>\n<td width=\"37\" valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    (a)<\/td>\n<td style=\"vertical-align: top; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                      all remittances from abroad for the purposes of his maintenance, education, study, research or<br \/>\n                      training;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"37\" valign=\"top\" style=\"text-align: justify; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                      any remuneration not exceeding United States Dollars two thousand two hundred per annum in respect<br \/>\n                      of services in that other State provided the services are performed in connection with his study,<br \/>\n                      research or training or are necessary for the purposes of his maintenance.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              &nbsp;<\/p>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 20<br \/>\n                TEACHERS AND RESEARCHERS<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  An individual who is a resident of a Contracting State immediately before making a visit to the other<br \/>\n                  Contracting State, and who, at the invitation of any university, college, school or other similar<br \/>\n                  educational institution, visits that other State for a period not exceeding two years solely for the<br \/>\n                  purpose of teaching or research or both at such educational institution shall be exempt from tax in<br \/>\n                  that other State on any remuneration for such teaching or research.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  This Article shall not apply to income from research if such research is undertaken primarily for the<br \/>\n                  private benefit of a specific person or persons.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 21<br \/>\n                INCOME NOT EXPRESSLY MENTIONED<\/b><\/p>\n<div class=\"art-pleft\" style=\"text-align: justify;\">\n              Items of income of a resident of a Contracting State which are not expressly mentioned in the foregoing<br \/>\n              Articles of this Agreement shall be taxable only in that Contracting State except that if such income is<br \/>\n              derived from sources in the other Contracting State, it may also be taxed in that other State.<\/div>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 22<br \/>\n                ELIMINATION OF DOUBLE TAXATION<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to the laws of Malaysia regarding the allowance as a credit against Malaysian tax of tax<br \/>\n                  payable in any country other than Malaysia, Indonesian tax payable under the laws of Indonesia and in<br \/>\n                  accordance with this Agreement by a resident of Malaysia in respect of income derived from Indonesia<br \/>\n                  shall be allowed as a credit against Malaysian tax payable in respect of that income. The credit shall<br \/>\n                  not, however, exceed that part of the Malaysian tax, as computed before the credit is given, which is<br \/>\n                  appropriate to such item of income.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of paragraph 1, the term &#8220;Indonesian tax payable&#8221; shall be deemed to include the<br \/>\n                  amount of Indonesian tax which would have been paid if the Indonesian tax had not been exempted or<br \/>\n                  reduced in accordance with this Agreement and:&nbsp;<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td class=\"art-listitem-label\" nowrap=\"nowrap\" style=\"width: 33px; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (a)<\/td>\n<td class=\"art-listitem-value\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        the special incentive laws designed to promote economic development in Indonesia so far as they<br \/>\n                        are in force on the date of signature of this Agreement; or<\/td>\n<\/tr>\n<tr>\n<td class=\"art-listitem-label\" style=\"white-space: nowrap; width: 33px; vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (b)<\/td>\n<td class=\"art-listitem-value\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        any other provisions which may subsequently be introduced in Indonesia in modification of, or in<br \/>\n                        addition to, the existing special incentive laws so far as they are agreed by the competent<br \/>\n                        authorities of the Contracting States to be of a substantially similar character.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Subject to the laws of Indonesia regarding the allowance as a credit against Indonesian tax of tax<br \/>\n                  payable in any country other than Indonesia, Malaysian tax payable under the laws of Malaysia and in<br \/>\n                  accordance with this Agreement by a resident of Indonesia in respect of income derived from Malaysia<br \/>\n                  shall be allowed as a credit against the Indonesian tax payable in respect of that income. The credit<br \/>\n                  shall not, however, exceed that part of the Indonesian tax, as computed before the credit is given,<br \/>\n                  which is appropriate to such item of income.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of paragraph 3, the term &#8220;Malaysian tax payable&#8221; shall be deemed to include Malaysian<br \/>\n                  tax which would, under the laws of Malaysia and in accordance with this Agreement, have been payable<br \/>\n                  on any income derived from sources in Malaysia had the income not been taxed at a reduced rate or<br \/>\n                  exempted from Malaysian tax in accordance with:&nbsp;<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td class=\"art-listitem-label\" style=\"white-space: nowrap; width: 33px; vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (a)<\/td>\n<td class=\"art-listitem-value\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        the special incentive laws for the promotion of economic development of Malaysia so far as they<br \/>\n                        were in force on, and have not been modified since, the date of signature of this Agreement or<br \/>\n                        have been modified only in minor respects so as not to affect their general character; and<\/td>\n<\/tr>\n<tr>\n<td class=\"art-listitem-label\" style=\"white-space: nowrap; width: 33px; vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (b)<\/td>\n<td class=\"art-listitem-value\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        any other provisions which may subsequently be introduced in Malaysia in modification of, or in<br \/>\n                        addition to, the investment incentives laws so far as they are agreed by the competent<br \/>\n                        authorities of the Contracting States to be of a substantially similar character.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ol type=\"a\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                <\/ol>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  For the purposes of paragraph 3, royalties derived by a resident of Indonesia from film rentals, which<br \/>\n                  are subjected to duty under the Cinematograph Film-Hire Act in Malaysia, that duty shall be deemed to<br \/>\n                  be Malaysian tax.<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 23<br \/>\n                NON-DISCRIMINATION<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The nationals of a Contracting State shall not be subjected in the other Contracting State to any<br \/>\n                  taxation or any requirement connected therewith which is other or more burdensome than the taxation<br \/>\n                  and connected requirements to which nationals of that other State in the same circumstances are or may<br \/>\n                  be subjected.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The taxation on a permanent establishment which an enterprise of a Contracting State has in the other<br \/>\n                  Contracting State shall not be less favourably levied in that other State than the taxation levied on<br \/>\n                  enterprises of that other State carrying on the same activities.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Enterprises of a Contracting State, the capital of which is wholly or partly owned or controlled,<br \/>\n                  directly or indirectly, by one or more residents of the other Contracting State, shall not be<br \/>\n                  subjected in the first-mentioned State to any taxation or any requirement connected therewith which is<br \/>\n                  other or more burdensome than the taxation and connected requirements to which other similar<br \/>\n                  enterprises of that first-mentioned State are or may be subjected.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Nothing in this Article shall be construed as obliging:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          a Contracting State to grant to individuals who are resident of the other Contracting State<br \/>\n                          any personal allowances, reliefs and reductions for tax purposes on account of civil status or<br \/>\n                          family responsibilities which it grants to its own residents;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td valign=\"top\" style=\"text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          Malaysia to grant to nationals of Indonesia not resident in Malaysia those personal<br \/>\n                          allowances, reliefs and reductions for tax purposes which are by law available on the date of<br \/>\n                          signature of this Agreement only to nationals of Malaysia who are not resident in Malaysia.\n                        <\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Nothing in this Article shall be construed so as to prevent either Contracting State from limiting to<br \/>\n                  its nationals the enjoyment of tax incentives designed to promote economic development in that<br \/>\n                  State.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  In this Article, the term &#8220;taxation&#8221; means taxes to which the Agreement applies.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 24<br \/>\n                MUTUAL AGREEMENT PROCEDURE<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  Where a resident of a Contracting State considers that the actions of one or both of the Contracting<br \/>\n                  States result or will result for him in taxation not in accordance with this Agreement, he may,<br \/>\n                  notwithstanding the remedies provided by the taxation laws of those States, present his case to the<br \/>\n                  competent authority of the State of which he is a resident or, if his case comes under paragraph 1 of<br \/>\n                  Article 23, to that of the State of which he is a national. The case must be presented within three<br \/>\n                  years from the first notification of the action resulting in taxation not in accordance with the<br \/>\n                  provisions of the Agreement.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The competent authority shall endeavour, if the objection appears to it to be justified and if it is<br \/>\n                  not itself able to arrive at an appropriate solution, to resolve the case by mutual agreement with the<br \/>\n                  competent authority of the other Contracting State, with a view to the avoidance of taxation which is<br \/>\n                  not in accordance with the Agreement.&nbsp;<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The competent authorities of the Contracting States shall endeavour to resolve by mutual agreement any<br \/>\n                  difficulties or doubts arising as to the interpretation or application of the Agreement. They may also<br \/>\n                  consult together for the elimination of double taxation in cases not provided for in the Agreement.\n                <\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The competent authorities of the Contracting States may communicate with each other directly for the<br \/>\n                  purpose of reaching an agreement in the sense of the preceding paragraphs.&nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 25<br \/>\n                EXCHANGE OF INFORMATION<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  The competent authorities of the Contracting States shall exchange such information as is necessary<br \/>\n                  for carrying out the provisions of this Agreement or for the prevention or detection of evasion or<br \/>\n                  avoidance of taxes covered by this Agreement. Any information so exchanged shall be treated as secret<br \/>\n                  and shall be disclosed only to any persons or authorities (including a Court or reviewing authority)<br \/>\n                  concerned with the assessment, collection, enforcement or prosecution in respect of, or the<br \/>\n                  determination of appeals in relation to, the taxes which are the subject of the Agreement.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  In no case shall the provisions of paragraph 1 be construed so as to impose on a Contracting State the<br \/>\n                  obligation:<\/p>\n<table class=\"verdana85pt\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (a)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          to carry out administrative measures at variance with the laws or the administrative practice<br \/>\n                          of that or of the other State;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (b)<\/td>\n<td valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          to supply particulars which are not obtainable under the laws or in the normal course of the<br \/>\n                          administration of that or of the other State;&nbsp;<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"36\" valign=\"top\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                        (c)<\/td>\n<td style=\"vertical-align: top; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                          to supply information which would disclose any trade, business, industrial, commercial or<br \/>\n                          professional secret, trade process, or information the disclosure of which would be contrary<br \/>\n                          to public policy.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  &nbsp;<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 26<br \/>\n                DIPLOMATIC AND CONSULAR OFFICER&#8217;S<\/b><\/p>\n<div class=\"art-pleft\" style=\"text-align: justify;\">\n              Nothing in this Agreement shall affect the fiscal privileges of diplomatic or consular officials under the<br \/>\n              general rules of international law or under the provisions of special agreements.<\/div>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 27<br \/>\n                ENTRY INTO FORCE<\/b><\/p>\n<ol data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  This Agreement shall be ratified by the Governments of the Contracting States and the instruments of<br \/>\n                  ratification shall be exchanged at &#8230; as soon as possible.<\/p>\n<\/li>\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n<p align=\"justify\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                  This Agreement shall enter into force upon the exchange of the instruments of ratification and shall<br \/>\n                  have effect for the year of assessment or taxation year beginning on the first day of January 1987 and<br \/>\n                  subsequent years of assessment or taxation years.<\/p>\n<\/li>\n<\/ol>\n<p align=\"center\" data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              <b>Article 28<br \/>\n                TERMINATION<\/b><\/p>\n<div class=\"art-pleft\" style=\"text-align: justify;\">\n              This Agreement shall remain in force until terminated by one of the Contracting States. Either Contracting<br \/>\n              State may terminate the Agreement through diplomatic channels, by giving to the other Contracting State<br \/>\n              written notice of termination at least six months before the end of the calendar year after the year 1991.<br \/>\n              In such event, the Agreement shall cease to have effect for the year of assessment or taxation year<br \/>\n              beginning on or after the first day of January of the calendar year next following that in which the<br \/>\n              notice is given.<\/div>\n<p><\/p>\n<div class=\"art-pleft\">\n              In witness whereof the undersigned, duly authorized thereto, by their respective Governments, have signed<br \/>\n              this Agreement.<\/div>\n<div class=\"art-pleft\">\n<div class=\"newline\">\n                &nbsp;<\/div>\n<div style=\"text-align: justify;\">\n                Done in duplicate at Kuala Lumpur this 12th day of September 1991, in Bahasa Malaysia, Bahasa Indonesia<br \/>\n                and English language, the three texts being equally authentic. width: 31px; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        (c)<\/td>\n<td class=\"art-listitem-value\" style=\"width: 1224px; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                        In connection with Article 7 &#8220;Business profits&#8221;, nothing in this Article shall prevent either<br \/>\n                        Contracting State from imposing, apart from the corporate income tax, a branch profits tax on<br \/>\n                        the after tax profits of the permanent establishment, provided that the tax so imposed shall not<br \/>\n                        exceed 12.5% of such amount.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/li>\n<\/ol>\n<ol style=\"list-style-type: decimal; font-size: 14px;\" start=\"5\" data-asw-orgfontsize=\"14\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                In connection with Article 10 &#8220;Dividends&#8221;, nothing in this Article shall affect the provisions contained<br \/>\n                in any production sharing contracts relating to the exploitation and production of oil and natural gas<br \/>\n                which have been negotiated with the Government of Indonesia or the relevant state oil company of<br \/>\n                Indonesia, provided that a company which is resident in Malaysia deriving income from a production<br \/>\n                sharing contract shall not be less favourably treated with respect to tax than that levied on a company<br \/>\n                of a third state deriving income from a similar production sharing contract.<\/li>\n<\/ol>\n<div class=\"verdana85pt\">\n<div class=\"verdana85pt\">\n<ol style=\"list-style-type: decimal; font-size: 14px;\" start=\"6\" data-asw-orgfontsize=\"14\">\n<li data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n                    In connection with Articles 11, 12, 16 and 18 the term &#8220;statutory body&#8221; and &#8220;the Protocol&#8221; respectively),<\/p>\n<p>              HAVE AGREED as follows:<br \/>\n              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 1<\/strong><\/div>\n<p><\/p>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              Paragraph 2 of Article 10 of the Agreement is amended by substituting for the words &#8220;15 per cent&#8221; the<br \/>\n              words &#8220;10 per cent&#8221;.<\/p>\n<p>              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 2<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              Paragraph 2 of Article 11 of the Agreement is amended by substituting for the words &#8220;15 per cent&#8221; the<br \/>\n              words &#8220;10 per cent&#8221;.<\/p>\n<p>              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 3<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              Paragraph 2 of Article 12 of the Agreement is amended by substituting for the words &#8220;15 per cent&#8221; the<br \/>\n              words &#8220;10 per cent&#8221;.<\/p>\n<p>              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 4<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              Paragraph 5 of the Protocol is substituted by the following new paragraph :<\/p>\n<p>              &#8220;In connection with Article 10 &#8220;Dividens&#8221; nothing in this Article shall affect the provisions contained in<br \/>\n              any production sharing contracts relating to oil and gas sector concluded by the Government of Indonesia,<br \/>\n              its instrumentality, its relevant state oil and gas company or any other entity thereof with a person who<br \/>\n              is a resident of Malaysia&#8221;.<\/p>\n<p>              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 5<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              For the purposes of this Protocol, it is understood that:<\/p>\n<table style=\"text-align: left; width: 100%;\" border=\"0\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td style=\"vertical-align: top; width: 32px; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    1)&nbsp;<\/td>\n<td style=\"vertical-align: top; width: 1096px; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    the benefits of the Agreement shall not be available in respect of the carrying on of any offshore<br \/>\n                    business activity under the Labuan Offshore Business Activity Tax Act 1990; and<\/td>\n<\/tr>\n<tr>\n<td style=\"vertical-align: top; width: 32px; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    2)&nbsp;<\/td>\n<td style=\"vertical-align: top; width: 1096px; text-align: justify; font-size: 14px;\" data-asw-orgfontsize=\"14\">\n                    &nbsp;the term &#8220;offshore business activity&#8221; means an offshore business activity as defined under<br \/>\n                    section 2 (1) of the Labuan Offshore Business Activity Tax Act 1990 in force at the date of<br \/>\n                    signature of this Protocol and includes any substantially similar activity dealt with in any<br \/>\n                    amendment to that Act thereafter.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              &nbsp;<br \/>\n              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 6<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              This Protocol shall be an integral part of the Agreement between the Government of the Republic of<br \/>\n              Indonesia and the Government of Malaysia for the Avoidance of Double Taxation and the Prevention of Fiscal<br \/>\n              Evasion with respect to Taxes on Income and its Protocol signed at Kuala Lumpur on the 12th day of<br \/>\n              September, 1991.<\/p>\n<p>              &nbsp;<\/p>\n<div style=\"text-align: center;\">\n              <strong>Article 7<\/strong><\/div>\n<p data-asw-orgfontsize=\"14\" style=\"font-size: 14px;\">\n              This Protocol shall be subject to ratification and instruments of ratification shall be exchanged as soon<br \/>\n              as possible. It shall enter into force on the date exchange of the instruments of ratification.
